Continued - Public Hearing – Notice of Intent – Spring Street – Town of Franklin DPW- CE159-996
Mr. William Yadisernia, Town Engineer, appeared before the Commission for emergency culvert repair work.   He submitted revised plans and addressed 3 comments from the Agent’s Report from the last meeting.  Perennial stream flows on the site.  Work to be done when water level is low.  A project narrative was submitted and added to the file.

The work falls under emergency contract with the State.  Work should also be performed during August.

There was no one present in the audience for this public hearing.

A Commission member requested that no haybales be used as they introduce invasive plantings but requested using compost sock instead.  Mr. Yadisernia stated compost socks do not work well on steep slopes and the Commission stated that haybales could be used in this project.

There was a motion to close the public hearing for Spring Street.  The motion was seconded and accepted with a vote of 5-0-0.


Public Hearing – Notice of Intent – Summer Street - Town of Franklin DPW- CE159-
Mr. William Yadisernia, Town Engineer, appeared before the Commission for the installation of a new water line.  Mr. Yadisernia submitted:      
  • project narrative, and
  • description of work with regard to wetlands.
The work encompasses approximately 1400 ft. long water line replacement from Crocker Ave. to Squibnocket Rd.  Approximately 300 ft. of water line is in buffer zone of seasonal brook and associated vegetated wetlands.  

All of work will be done within existing roadway limits.  

There was no one present in the audience for this public hearing.

Mr. Yadisernia informed the Commission that on this site compost socks will work well for erosion control rather than haybales.

The Commission will conduct a site walk on Monday, July 26th at 6:30 p.m.

There was a motion to waive the fees for this project.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to continue the hearing for Summer Street Water Line until July 29th.  The motion was seconded and accepted with a vote of 5-0-0.


Public Hearing – Notice of Intent – Elm Street & Anchorage Road – Town of Franklin DPW- CE159-
Mr. Chris Botchis, Conservation Commission member, stated that he lives on Elm Street but is outside the abutter notification area and in no way will this affect his vote of the project.

Mr. William Yadisernia, Town Engineer, appeared before the Commission for the reconstruction of existing roadway and storm water drainage system improvements.  Mr. Yadisernia submitted:

  • a  project narrative
  • a letter regarding flagging of wetlands
  • 25 and 50 ft. buffer zones have been added to plans
The project includes reconstruction of 2200 linear feet of Anchorage Road and about 500 ft. of Elm Street.  The project falls in the outer riparian zone of Shepard’s Brook.

Mr. Yadisernia reviewed the site plans for the Commission.  

There will be stormwater discharges to Shephard’s Brook.  There will be 1600 sq. ft. of impervious coverage.  There will be a raingarden outside the buffer zone at the end of Anchorage Road.  

The Chairman stated that under the Riverfront Protection Act stormwater management structures are allowed.

There was no one present in the audience for this public hearing.

There was a motion to waive the fees as this is a Town project.  The motion was seconded and accepted with a vote of 5-0-0.

A Commission member requested that rebars or steel pickets not be used to hold the haybales in place and Mr. Yadisernia agreed to this.


The Commission will conduct a site walk on Monday, July 26th at 6 p.m.  

There was a motion to continue the public hearing until the July 29th meeting.  The motion was seconded and accepted with a vote of 5-0-0.


GENERAL BUSINESS

        Minor Buffer Zone Activity:  82 South Street
        The applicant has requested to install a 24 ft. round above-ground swimming pool.  It is        located 26 ft. from the wetland at the closest point.  The wetland is an isolated wetland.
        
        The applicant has submitted a revised plan for review.

        There will be approximately 900 sq. ft. of soil disturbance in performing this work.    There will be a closed-cartridge filter used in the pool.  There will be no backwashing         for the pool.
        
        There was a motion to issue a Negative Determination.  The motion was seconded and      accepted with a vote of 5-0-0.

        Permit Decision:  14 King Philip Road – CE159-995
        Discussion ensued among Commission members regarding the issuance of Orders of  Conditions for this project.

        There was a motion to issue State and Local Orders of Conditions for 14 King Philip     Road with the special conditions handed out tonight.  The motion was seconded and       accepted with a vote of 3-2-0; 3 Yes, 2 No, 0 Abstentions.

        Extension Permit:  16 Vine Street – CE159-939
        Applicant has requested a three-year Extension to Orders of Conditions.  Economy and    personal reasons prevented work from commencing.  This would be first Extension         issued.

        There was a motion to issue a one-year Extension Permit for 16 Vine Street.  The motion         was seconded and accepted with a vote of 5-0-0.

        Extension Permit:  Oak Hill Village – Washington Street – SE159-921
        Applicant has requested an Extension to Orders of Conditions.  Economy has slowed
        construction; Phase III presently under construction.  There has been one Extension     Permit previously issued for this site.

        There was a motion to issue a one-year Extension Permit for Oak Hill Village.  The      motion was seconded and accepted with a vote of 5-0-0.
